SPECIFICALLY DISCLAIM THE IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

You agree that you will provide no information to or through SalvageService.com and/or to any sellers or purchasers using SalvageService.com which is false, inaccurate, misleading, fraudulent, harassing, libelous, involves the sale of counterfeit or stolen items, infringes any third party's copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy, contains any virus, would or may cause liability on the part of regulation (including without limitation those governing obscenity or false advertising). SalvageService.com reserves the right to terminate any auction at any time without incurring liability where it is believed, in the sole discretion of SalvageService.com, that the auction violates or may violate any term(s) of this Agreement. In order not to violate any rights you might have in information you provide you agree to grant SalvageService.com and Charles L. Williams, Inc. a non-exclusive, worldwide, perpetual, irrevocable and royalty-free right to exercise the copyright and publicity rights (but no other rights) you have in any media now known or not currently known with respect to the information you provide.

Terms of sale, including the release of items listed for sale, shall be as agreed to between the seller and the purchaser. Unless otherwise agreed to between seller and purchaser: (1) The purchaser is responsible for all handling out charges and transportation arrangements and charges; (2) The purchaser is expected to take immediate delivery of the items upon receipt of the release; and (3) Storage after the indicated date will be for the account of the purchaser.

In the event you have a dispute with one or more users, you release SalvageService.com and Charles L. Williams, Inc., their agents and employees, from any and all claims, demands, damages, actual and consequential, of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, you waive California Civil Code 1542, which provides: "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor".

SalvageService.com makes every effort to maintain 100% system integrity and availability, except during scheduled maintenance periods. Should SalvageService.com and Charles L. Williams, Inc. experience technical difficulties, SalvageService.com and Charles L. Williams, Inc. are not responsible for bids that are not processed or accepted.

IN NO EVENT SHALL SALVAGESERVICE.COM OR CHARLES L. WILLIAMS, INC. BE LIABLE FOR LOST PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (HOWEVER ARISING, INCLUDING NEGLIGENCE) ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT. OUR LIABILITY TO YOU OR TO ANY THIRD PARTY IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A)THE AMOUNT OF FEES YOU PAY TO US
IN THE 12 MONTHS PRIOR TO THE ACTION GIVING RISE TO LIABILITY, AND (B)$100. You agree to indemnify and hold SalvageService.com an Charles L. Williams, Inc., their affiliates, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or your violation of any law or the rights of a third party. This Agreement shall be governed in all respects by the laws of the State of Georgia.

The service fee is a commission of 5% or $50, whichever is greater, after the item is sold, payable by the seller. All Lloyd's agents and those approved by SalvageService.com, may retain 2 1/2% of this fee as an agency commission.
